Bengals' Cedric Benson appeals three-game suspension

Unhappy with his union, the Cincinnati Bengals' Cedric Benson pleaded his case Tuesday before the NFL in an attempt to reduce a potential three-game suspension for an arrest while he was unemployed.

During the owners' lockout of players, the runningback was arrested outside a bar in July in Austin, Texas and charged with assault. At the time, no Collective Bargaining Agreement existed between the NFL and the NFLPA.

Upon signing a new CBA on Aug. 5 that ended the labor stalement, the players' association agreed in a side letter with the league to allow Commissioner Roger Goodell discipline eight repeat-offender players.

The league agreed to exempt 25 players, who were not considered repeat offenders, from punishment. The union's position is that no player should be disciplined for any legal incidents during the lockout.

"You would think (the NFLPA is) here to support you and have your back — that's what a union does," Benson told the Associated Press after Sunday's loss to San Francisco "I guess in my case, it's different."

The Cincinnati Enquirer reports that Benson has filed an unfair labor practice grievance against the players' association with the National Labor Relations Board. The NFLPA appeared with Benson on his behalf before the commissioner's representatives in New York. The league rendered no decision. Goodell's decision is binding.

The issue is intriguing because "there is not much precedent to guide either side," said Gabe Feldman, associate professor and director of sports law at Tulane.

" It certainly raises some questions about whether the league should be able to say you cannot be paid while we lock you out — but you can be punished."

Listeria Deaths & Nightly Roundup

Two deaths from eating contaminated cantaloupe are reported in North Texas. Tuesday, Tarrant County Public Health officials confirmed the death of an elderly resident with underlying medical conditions, and illness in a second case. Monday, Dallas County reported an 89 year old resident died from listeriosis, one of four cases.

Carrie Williams, with the Department of State Health Services says 14 cases have been reported in Texas, and the number is likely to grow.

Williams: The incubation period with listeriosis is tremendously long. Symptoms can occur anywhere from three to 70 days after exposure, which is what makes these cases so difficult to solve.

The listeria-contaminated cantaloupe from Jensen Farms in Colorado was shipped to Texas between July and September 10th. It has been recalled. Williams says anyone with symptoms of diarrhea, fever and muscle aches should see a doctor.

Top Parkland Managers Denied Merit Raises

Dallas County Commissioners approved Parkland Hospital's budget Tuesday -- minus some eight million dollars in performance bonuses for top administrators.

Commissioner Elba Garcia said those merit raises would be inappropriate after the hospital failed a critical federal investigation and must submit to outside management oversight. And she says rescinding the raises will not hurt the hospital's ability to recruit top health professionals.

Garcia: The Board did look at some of those salaries, current salaries without incentives. And guess what. They're very competitive in the marketplace.

Friday, the Parkland Board reworked its budget to eliminate the bonuses for a dozen top managers. They include the CEO, and Chief Medical Officer, plus the directors of Medical and Surgical Services and Nursing Operations.

Pay For Jurors Cut

Starting Wednesday, jurors in Texas take a "pay cut".

Since 2006, jurors have gotten six dollars for the first day of service, and 40 dollars for each day thereafter. Tarrant County Administration G.K. Maenius told commissioners the Legislature cut that amount in the budget.

Maenius: So the Comptroller will certify a daily amount that she'll reimburse on a quarterly basis. That amount is 28 dollars.
Brooks: So that amount may change from quarter to quarter?
Maenius: Yes sir it will, possibly, yes.

Counties pay jurors, then get reimbursed from a state fund supported by a four dollar fee on tickets and offenses. Less of that is now going for juror compensation.

J. Cole Gets Off Rap's Sidelines With Cole World

On Tuesday (September 27), J. Cole finally got up off the bench.

The Roc Nation rapper has presented each of his mixtapes — The Come Up, The Warm Up, and Friday Night Lights — with a sports analogy, and his major label debut is no different. Cole World: The Sideline Story, in stores today, tells the story of a young star yearning to get his shot at the big time.

"I'm pretty sure we're gonna celebrate somewhere," Cole told MTV2's Sucker Free of his release-day plans. "But to me, I think the real satisfaction and joy will come from when I go to the actual store and see that physical CD right there in my hands and I can look at it and go up and pay for it."

It's been a long road for the Jay-Z protégé. He first made a name for himself in 2007 with The Come Up and quietly signed to Jay-Z before he released his Warm Up mixtape in '09. He is a former XXL Freshmen cover subject, appeared on Hov's Blueprint III and has toured with Rihanna. But even with all of his accomplishments, Cole's debut went through a series of starts and stops. Not that the North Carolina rapper's career trajectory was that different from his rap contemporaries like B.o.B, Wale and Big Sean, but dropping an album has been a longtime goal for Cole.

Cole World is packed with radio-ready singles like "Can't Get Enough" (featuring Trey Songz), "Workout," and the Drake collaboration "In the Morning." There are potent album cuts as well. "Dollar and a Dream III" details Cole's artistic struggle, while "Lost Ones" tackles the topic of abortion and the effect that it can have on a young couple. "Mr. Nice Watch" features Jay-Z and the Missy Elliott-featuring "Nobody's Perfect" perfectly channels Misdemeanor's late-1990s R&B reign.

The release has lifted a weight off the young MC's shoulders.

"Even talking about it right now, I'm getting a little emotional because I can remember going to get so many albums and just the fact that mines is one of those," he said. "To me, that'll be the real incredible feeling, like all the things I've been through will finally be worth it because we made it to that."

Zach Braff

Zachary Israel "Zach" Braff (born April 6, 1975) is an American actor, writer, singer, producer and director. Braff was first known in 2001 for his role as Dr. John Dorian in the TV series Scrubs. He was nominated for an Emmy Award and three Golden Globe Awards for his work on Scrubs.

Sean Avery, who appeared in the PSA supports marriage equality in New York this spring, and that he had publicly criticized the sports agent talking to legalize gay marriage, called homophobic insults by Flyer Wayne Simmonds in the first period of their pre-season game on Monday.

He is not sure what he said beforehand that "Simmonds encouraged hatred." Honestly, we were going back and forth for a while, "said Simmonds." I do not remember what I said about him, but said some of the things I did and may not have said some things that did not like. I do not remember every word I said. "

Flying coach, said: "It's been a couple of guys competing there."

"Hate speech and anti-gay slurs have no place on the ice," GLAAD president Acting Mike Thompson said in a statement. It should not only apologize for the anti-gay outburst, but the Philadelphia Flyers and the NHL has a responsibility to intervene and educate their supporters why the word is unacceptable. "

Avery hopes that, as Kobe Bryant, Simmonds will be sanctioned for their language. "This is a problem," he said. "It's a question that people are facing and trying to overcome, and ten years ago, maybe not so much an issue, but it is certainly a political issue with people in the game. And life in general.

Cantaloupe outbreak could be deadliest in a decade

WASHINGTON (AP) - Health officials say up to 16 people died of diseases related to possible Listeria Colorado melons, the most lethal outbreak of food for more than a decade.

Centers for Disease Control and Prevention said Tuesday that 72 diseases, including 13 deaths linked to contaminated fruit. State officials say they and local investigation into three other deaths that can be connected.

The death toll released Tuesday by the CDC - including newly-confirmed deaths in Kansas, Missouri, Nebraska and Texas - has exceeded the number of deaths from an outbreak of Salmonella in peanut almost three years ago. Nine people died in the epidemic.

The CDC said Tuesday that they have confirmed two deaths in Texas and one death each in Kansas, Missouri and Nebraska. Last week, the CDC has reported two deaths in Colorado, four deaths in New Mexico, one in Oklahoma and one in Maryland.

New Mexico, officials said Tuesday they are investigating the fifth died, while the health authorities in Kansas and Wyoming said they are investigating more deaths possibly linked to contaminated fruit.

Listeria is more deadly than the known pathogens such as Salmonella and E. coli, these epidemics usually cause many more diseases. Twenty-one died in an outbreak of listeria poisoning in 1998 back to contaminated hot dogs and possibly deli meats because of Foods in March, a subsidiary of Sara Lee Corp., another outbreak in 1985 killed 52 people and was linked to Mexican soft cheese.

Listeria usually only get sick elderly people, pregnant women and others with weakened immune systems. The CDC said the average age is 78 and disgusted that one of the five who become ill may die.

Dr. Robert Tauxe of the CDC says the number of illnesses and deaths will probably grow in the coming weeks, because the symptoms of listeria are not always right away. It may take four weeks or more for a person to become ill after eating food contaminated with Listeria.

"The incubation time is long is a real problem," Tauxe said. "People who eat contaminated food two weeks ago, or even a week ago could still become ill weeks later."

CDC reported 72 cases and deaths in 18 states. Cases of listeriosis have been reported in California, Colorado, Florida, Illinois, Indiana, Kansas, Maryland, Missouri, Montana, Nebraska, New Mexico, North Dakota, Oklahoma, Texas, Virginia, West Virginia, Wisconsin and Wyoming. Most diseases have been reported in Colorado, he saw sickened 15. Fourteen patients have been reported in Texas, 10 in New Mexico and eight in Oklahoma.

The outbreak was traced Jensen Farms in Holly, Colorado, which is contaminated melons recalled earlier this month. The Food and Drug Administration, said state health officials had found listeria melons in grocery stores in the state and the home of the victim, who had grown Jensen Farms. The positions of the disease was found in samples of equipment and packaging equipment melon Jensen Farms' in Granada, Colorado

The FDA investigation into the cause of food-borne outbreaks, has not released details on how contamination could have happened. The agency says that the investigation is ongoing.

Rocky Ford cantaloupe farms Jensen were shipped from July 29 through Sept. 10 at Arkansas, Arizona, California, Colorado, Idaho, Illinois, Kansas, Minnesota, Missouri, Montana, Nebraska, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Dakota, Tennessee, Texas, Utah, Virginia, and Wyoming.

Recalled Melons can be labeled as "Colorado Grown", "Product Distributed by Frontier," "Jensenfarms.com" or "Sweet Rocky Ford." Not all cantaloupes recalled are marked with a label, the FDA said.

Unlike many pathogens that can grow Listeria at room temperature and even the refrigerator. The FDA and the CDC recommends that anyone can have one of the contaminated cantaloupes immediately throw away and clean and disinfect all surfaces that may have touched.

About 800 cases of listeriosis are in the United States each year, according to the CDC, and usually three or four buds. Most of them date back to processed meats and soft cheeses, where Listeria is more common.

Produce has rarely been the culprit, but federal investigators say they saw more to produce the listeria-related illnesses in the last two years. It was found in 2009 in the cabbage and celery in 2010.

Although most healthy adults can consume without side effects Listeria can kill the elderly and those whose immune system. It is also dangerous for pregnant women because it easily crosses the fetus. Dr. Tauxe, the CDC, said the type of listeria linked to the melon is not one that is associated with pregnancy-related diseases, however. Health officials and federal state have not definitively linked to miscarriages, stillbirths or childhood diseases in the current outbreak.

Symptoms include fever, muscle aches and Listeria, often with other gastrointestinal symptoms. Victims often become disabled and unable to speak.

Debbie Frederick, said his mother knew something was wrong when his father, 87 years, Thomas William Beach, collapsed at his home in Mustang, Oklahoma, and could not get up. He died a few days later, on September 1. The family learned of his death was related to eating melon farms and continued Jensen.

"First, we just need a jolt," said Frederick. "Then it is deposited, which was still alive, if this had not occurred. It is life, what?"

More Than 20M Computers Infected by Conficker, and Counting

The highly encrypted worm called Conficker may secretly enter and run the PC became infected with more than 20 million computers for the last three years, according to Kaspersky Lab.

Auto-update the worm penetrates the heart of the computer's operating system and transfer control to the remote control, by Mark Bowden wrote the author of the worm: The First Digital World.

Recently, Conficker has caused the loss of £ 7.2 million production of SABMiller, the brewer of Peroni, Coors Light and Foster. SABMiller had to close its operations in Romania in April for several hours because the worm.

Reported in 2008, Conficker has sent security experts around the world rushed to try to stop the botnet. Conficker Working Group, a group of experts who offered that the reason the government was trying to get involved in their efforts, but noted that they have a lot of explaining to get the message that officials Conficker is capable of.

Even organizations that are responsible for protecting the country's power grid, telecommunications and did not have sufficient knowledge of Conficker.

Now Conficker has changed, which is commonly known today: the botnet. It 'became a powerful malicious software that can be taken to computer networks, which regulate banking, telephones, security systems, air traffic control, and even the Internet itself, according to Bowden's book.

Bowden provides an overview of how terrifying the scope of Conficker overwhelming capacity for infection. Botnet, according to him, could be used as a weapon, which is what shakes the state officials in their bones.

Consider the denial of service attacks Conficker launch on 10 million computers, the attack is not only a goal down, but the whole Internet world as well.

"This is equivalent to the closure of the commuter train system during the Civil War, when Union troops and Confederate troops trains used to transport arms and ammunition and supplies in their area of control," said Bowden .

But it is not necessary in the digital age, you can do today, taking over the Internet, he added.

In addition, the Panel found that the designers were really Conficker Conficker after the creation of money, not mass destruction or dismantling the Internet.

From that moment, nobody knows exactly who controls Conficker, or what his intentions are, Bowden said.

He said Conficker is increasingly infecting the computers of large institutions, including the FBI, the Pentagon and large corporations.

Cyber criminals can steal passwords from users via Conficker.

With a botnet of 25,000 computers, hackers can break the security codes for the accounts of people raid or Amazon.com or obtain Social Security numbers and data, Bowden warned.

"There is almost no commercial security system that could not be broken by a supercomputer with tens of thousands."

Global Research Kaspersky Lab and the team offered this analysis to be done to fight botnets, including Conficker: to allow researchers to carry out the remediation of soil through a botnet, to provide immunity laws cyber crime in a particular investigation, which can use system resources at risk during an investigation, and provide assurances to participate in the operation of remote control system when no other n is available.
